Terms and Conditions

These Terms and Conditions govern the use of the RMS Imports website and all vehicle sourcing, importing and sales services provided by RMS Imports (“we”, “us”, “our”).

By placing an order, paying a deposit or using our services, you agree to these Terms and Conditions.

1. About Us

RMS Imports is a UK-based vehicle sourcing and importing business specialising in premium Japanese and European vehicles.

Our services include:

• Vehicle sourcing from Japanese auctions and dealerships.
• Vehicle importing and customs management.
• Vehicle preparation and UK registration.
• Retail sale of imported vehicles.
• Bespoke vehicle sourcing services.

2. Vehicle Sourcing Service

Where a customer instructs RMS Imports to source a vehicle on their behalf, we act as a sourcing and import specialist.

We will:

• Search Japanese auctions and approved suppliers.
• Provide vehicle specifications and auction information.
• Recommend suitable vehicles.
• Arrange export and shipping.
• Arrange UK customs clearance.
• Arrange IVA testing where required.
• Arrange UK registration where applicable.

We do not guarantee that a particular vehicle will become available within any specific timeframe.

3. Customer Approval

No vehicle will be purchased unless approved by the customer.

Customers are responsible for reviewing:

• Vehicle photographs.
• Auction sheets.
• Specifications.
• Mileage.
• Grade reports.
• Estimated costs.

Once approval has been provided and the vehicle has been successfully purchased, the order becomes legally binding.

4. Deposits

Customer Sourced Vehicles

A deposit of 20% of the estimated vehicle cost is required before we begin sourcing and bidding on your behalf.

Deposits are used to:

• Secure our sourcing service.
• Demonstrate genuine purchasing intent.
• Cover costs incurred during the import process.

Refund Policy

Deposits are fully refundable if:

• We are unable to source a vehicle meeting your agreed specifications within a reasonable period.

Deposits are NOT refundable where:

• A vehicle has been successfully purchased.
• The customer changes their mind.
• The customer fails to complete payment.
• The customer withdraws after approving the purchase.

5. Vehicle Pricing

Vehicle pricing may include:

• Purchase price.
• Japanese auction fees.
• Export fees.
• Inland transportation.
• Shipping costs.
• Marine insurance.
• Import duties.
• VAT.
• Customs clearance charges.
• IVA fees.
• MOT fees.
• Registration fees.
• UK preparation costs.
• Delivery charges.
• RMS Imports service fees.

All quotations are estimates unless specifically stated as a fixed price quotation.

Shipping costs and government charges may fluctuate without notice.

6. Vehicle Condition

Japanese imported vehicles are pre-owned unless otherwise stated.

Whilst we make every effort to verify vehicle condition, customers acknowledge that:

• Auction grading is provided by third parties.
• Minor cosmetic imperfections may not be identified.
• Wear and tear is consistent with the vehicle’s age and mileage.
• Specifications may differ from UK models.
• Features may vary from manufacturer brochures or online sources.

Vehicle descriptions are provided in good faith but do not constitute a warranty.

7. Imported Vehicle Disclaimer

Customers acknowledge that imported vehicles may:

• Have Japanese language displays.
• Require software updates or conversions.
• Have different radio frequencies.
• Differ in specification from UK equivalents.
• Require modifications for UK road compliance.

RMS Imports will advise customers where modifications are necessary.

8. Delivery Times

Typical import times are between 8 and 16 weeks.

Delivery estimates are subject to:

• Shipping schedules.
• Customs inspections.
• Port delays.
• Vehicle preparation requirements.
• IVA testing availability.
• DVLA processing times.
• Weather conditions.

Delivery dates are estimates only and do not form part of any contractual guarantee.

9. Customs and Import Charges

Unless otherwise agreed in writing, all applicable charges will be included within the agreed quotation.

These may include:

• Import duty.
• VAT.
• Customs clearance fees.
• Port charges.
• Registration fees.

Government charges are subject to change and remain outside our control.

10. UK Registration

Where included within your package, RMS Imports will arrange:

• IVA testing where required.
• MOT testing.
• Vehicle registration.
• Number plates.

Delays caused by third-party organisations, including the DVLA, are outside our control.

11. Stock Vehicles

Vehicles advertised as UK stock vehicles are sold in accordance with UK consumer legislation.

Customers purchasing stock vehicles benefit from their statutory consumer rights.

Any warranties offered will be clearly stated within the vehicle advertisement or sales documentation.

12. Warranties

Unless otherwise stated:

• Imported vehicles are supplied without a manufacturer’s UK warranty.
• Any dealer warranty provided by RMS Imports will be specified at the time of sale.
• Third-party warranty products may be offered.

Warranty exclusions will be supplied separately where applicable.

13. Vehicle Reservations

Stock vehicles may be reserved upon payment of a reservation fee.

Reservation fees are refundable only if:

• RMS Imports is unable to supply the vehicle.

Reservation fees are non-refundable if:

• The customer cancels the purchase.

14. Customer Obligations

Customers agree to:

• Provide accurate personal information.
• Make payments when due.
• Review all vehicle documentation provided.
• Obtain appropriate insurance before collection.

Failure to provide required documentation or payments may result in delays or cancellation of the transaction.

15. Payment Terms

Unless otherwise agreed:

• A 20% deposit is payable upon order.
• The remaining balance must be paid before collection or delivery.

Vehicles remain the property of RMS Imports until payment has been received in full.

16. Right to Refuse Orders

RMS Imports reserves the right to:

• Refuse any order.
• Refuse bids considered commercially unreasonable.
• Cancel transactions where pricing errors have occurred.
• Cancel transactions where fraudulent activity is suspected.

17. Limitation of Liability

RMS Imports shall not be liable for:

• Shipping delays.
• Customs delays.
• Auction house errors.
• Third-party inspection inaccuracies.
• Currency fluctuations.
• Government fee increases.
• Acts of God.
• Port disruptions.
• Mechanical failures occurring after delivery that are not covered by warranty.

Nothing within these Terms excludes liability which cannot legally be excluded under UK law.

We make reasonable efforts to ensure the accuracy of all information displayed on our website.

Vehicle specifications, pricing and availability may change without notice.

19. Intellectual Property

All website content including:

• Logos.
• Images.
• Branding.
• Graphics.
• Text.

remain the property of RMS Imports unless otherwise stated.

Unauthorised reproduction or commercial use is prohibited.

20. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable UK data protection legislation.

21. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
